Marital rape is the act of sexual intercourse with ones spouse without their consent. Personal consent is an essential element in sexual intercourse; lack of personal consent must involve physical violence, therefore considered rape. Marital rape is mostly experienced by women and is considered a chronic form of violence on abusive relations victims. Histrorically forced, sexual engagement among spouse has been regarded right, but today engagement in sexual intercourse with a spouse without his/ her consent is considered rape. The acts are currently repudiated and are increasingly being criminalized by most of the countries worldwide. Marital rape has been a growing issue currently and is considered as an issue of violence against women. The issue of marital rape has raised international awareness; this is because it is a form of domestic violence mostly against women, despite being a form of domestic violence, it is not considered a criminal law in most countries, or it may considered a criminal law but still tolerated in these countries. The laws against this form of criminal violence are rarely enforced due to a number of challenges such as the delays by law firms in pursuing the crime due to lack of public knowledge that sexual intercourse with one's consent in marriage is illegal (Adinkrah, 2011). Many countries worldwide had criminalized marital rape by the late 20th century through various ways, such as the explicit legislative reference in statutory law preventing the use of marriage as a defense in marital rape. This paper therefore focuses on different legal view of marital rape.
